I'm not 100 percent sure this is how it works but I also think that the whole apl -4 thing is for the whole encounter, not the single enemy you fight. I think you should only be able to actively encircle, so if the enemy troops are completely surrounded by own troops, they should receive the surrounded status with all the negative consequences. I've been playing RPGs for a long time, and I've never seen a written rule where the GM can decide if you get to use your class features today or not.

As my group's GM, I generally stick to the level -4 bit, which is something I keep note of when designing encounters. I understand it's possible the enemy is just outrunning me at my 19 knot BB but a couple of the campaign games now have ended in defeat somehow because I could not find the enemy. The authors did a very good job in the detail and scope of the book keeping their views honest and non-judgemental. Though it goes both ways with the way it's worded, and a GM can use that to ignore it if they want, I still see it as permission to remove players' core abilities. But as I design 30 unique enemies (non-boss) I start to wonder if people will have a hard time remembering what each enemy does and how to defend/defeat it.The GM can and should declare that an ineffectual foe is not enough of a threat to count as an enemy for effects that grant you a benefit when you do something to an enemy or have an enemy do something to you. Really feels like you're imagining situations where a cruel and vindictive GM could abuse rules to shut off player abilities.
