About this deal

How do couples navigate the murky waters of infidelity? A new study offers a lens into the complex interplay of psychology and interpersonal relationships post-infidelity. A representation can be made by omission, for example, by omitting to mention previous convictions or County Court Judgements on an application form. A person is unable to consent to the infliction of harm that results in ABH or other more serious injury, for the purposes of obtaining sexual gratification: s.71 Domestic Abuse Act 2021, which codifies the principle set out in the case of R v Brown [1993] 2 WLR 556 . Buller and Burgoon (1996) have proposed three taxonomies to distinguish motivations for deception based on their Interpersonal Deception Theory: a b c Guerrero, L., Anderson, P., Afifi, W. (2007). Close Encounters: Communication in Relationships (2nd ed.). Los Angeles: Sage Publications.

A person may have reasonable grounds to suspect that property is one thing (A) when in fact it is something different (B). But that is not so when the question is what a person knows. A person cannot know that something is A when in fact it is B. The proposition that a person knows that something is A is based on the premise that it is true that it is A. The fact that the property is A provides the starting point. Then there is the question whether the person knows that the property is A." The High Court and the Court of Appeal considered the application of section 74 SOA 2003 in the cases highlighted above where ostensible consent was said to be vitiated. The judgments identified three sets of circumstances in which consent to sexual activity might be vitiated where the ‘condition’ was breached. The test of reasonable belief is a subjective test with an objective element. The best way of dealing with this issue is to ask two questions. The prosecution must show that the defendant did the relevant act and that either of the circumstances in subsection 2 applies: Ziano, I., & Wang, D. (2021). Slow lies: Response delays promote perceptions of insincerity. Journal of Personality and Social Psychology. Advance online publication. https://doi.org/10.1037/pspa0000250Gain" includes a gain by keeping what one has, as well as a gain by getting what one does not have (Section 5 (3)).

The focus of the charge is the false representation. In most cases this will be the same as the deception under the old Theft Act offences. Prosecutors must analyse what the representation was and importantly when it was made, as simply as possible, for example: Use of cheques and cheque or credit cards However, circumstances will arise where the issues are clear and the offences are serious. If so, prosecution may be required in the public interest. Prosecutors should ensure that the state of affairs between the parties has not changed prior to any trial. This may affect both the public interest and the evidential test. In R. v Barton and Booth [2020] EWCA Crim Mr Barton and Mrs Booth appealed their convictions on the grounds that the trial Judge had erred in directing the Jury on the issue of dishonesty by applying Lord Hughes’ new two stage test, which was obiter dictum, and not the two stage test set out in R v Ghosh [1982] EWCA Crim 2. Knowledge" in Section 7 (1) (a) is a strict mens rea requirement. The House of Lords in Montila [2004] UKHL 50 said: Deception is a major relational transgression that often leads to feelings of betrayal and distrust between relational partners. Deception violates relational rules and is considered to be a negative violation of expectations. Most people expect friends, relational partners, and even strangers to be truthful most of the time. If people expected most conversations to be untruthful, talking and communicating with others would require distraction and misdirection to acquire reliable information. A significant amount of deception occurs between some romantic and relational partners. Monash University, October 2011.
